Become A Brand Ambassador

Welcome to the MaDog Brand Ambassador Program! By becoming a brand ambassador ("Ambassador") for MaDog Designs ("MaDog"), you agree to represent our brand and promote our unique handmade dog products with enthusiasm and authenticity.

1. Endorsed Products:

Endorsed products are those sold under the MaDog brand name, including our rope collars, rope leashes, bandanas and other handmade dog accessories.

2. Ambassador Requirements:

Your responsibilities as a MaDog Brand Ambassador are outlined in the Ambassador Requirements section provided during your application process and on your Ambassador dashboard. These requirements are hereby incorporated into this agreement by reference.

Requirements may include:

   - Maintaining an active, public Instagram account for your dog with a minimum of 250 followers and posting 2-3 times per week.

   - Following MaDog Designs on Instagram @MaDogDesigns.

   - Being at least 18 years of age and based in the United States.

   - Complying with all federal, state, and local regulations, including applicable laws governing marketing emails (e.g., CAN-SPAM Act).

3. Promotion of Endorsed Products:

Ambassadors agree to use their best efforts to promote MaDog's Endorsed Products in a manner consistent with authorized use and as outlined by MaDog Designs. Approved channels for promotion include:

   - Your own website or blog.

   - Social media platforms such as Instagram, TikTok, and Facebook.

   - Emails to friends and family (no spam).

4. Prohibited Content:

Ambassadors agree not to post content that:

   - Is pornographic, sexually explicit, or suggestive.

   - Contains profanity, nudity, or promotes illegal activities.

   - Endorses hate speech or derogatory remarks against any group or individual.

   - Violates any laws or infringes on the intellectual property rights of others.

5. Rights to Use Images:

MaDog Designs retains the right to use any images or content provided by the Ambassador on MaDog's social media platforms, website, and promotional materials.

6. Indemnification:

Ambassadors agree to hold MaDog Designs, its officers, agents, assignees, and employees harmless from any liability arising from the use or promotion of MaDog's Endorsed Products.

7. Relationship:

This agreement does not create an employer/employee relationship between the Ambassador and MaDog Designs.

8. Confidentiality/Use:

Ambassadors may receive confidential information from MaDog Designs and agree to maintain this information in strict confidence. Disclosure of confidential information will result in termination of this agreement.

9. Term and Termination:

The effective date of this agreement is 06/27/2024. The initial term of this agreement is one (1) year and will automatically renew for successive one-year terms unless terminated by either party with at least 30 days' notice.

10. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of North Carolina. Any disputes shall be resolved in the state or federal courts located in Gastonia, North Carolina.

11. Discount Code Usage:

   - Ambassadors will receive a personal 15% discount code for their own use only, which is non-transferable and must not be shared.

   - The 10% discount code, intended for sharing with friends and followers, cannot be used by ambassadors to purchase items for themselves to earn a commission.

   - Under no circumstances may either discount code be shared on any coupon website or unauthorized channels.

   - Violation of these terms will result in immediate termination from the program and forfeiture of any commission earned.

12. Commission Credit:

As a MaDog Brand Ambassador, you may earn commission on Net Sales generated through your unique discount code, subject to terms outlined by MaDog Designs. Commissions are typically issued as store credit for use on www.MaDogDesigns.com or www.MaDogDesignsCo.etsy.com

13. Removal:

MaDog Designs reserves the right to remove any Ambassador from the Brand Ambassador Program for failure to comply with program requirements or for conduct deemed detrimental to MaDog's brand reputation.

14. Modification:

MaDog Designs may modify the terms and conditions of this Agreement with 30 days' notice. Continued participation in the program after such notice constitutes acceptance of the changes.

15. Entire Agreement:

This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or discussions.
